Terms of Service

pix.cy is a web design and development studio based in Cyprus. These Terms of Service govern your use of our website and your engagement with us for any services, including web design, development, hosting, maintenance, and automation. By visiting this website or engaging our services, you agree to these Terms. Where a signed contract or project proposal exists, that document takes precedence over these general Terms.
Proposals & Contracts
Every project begins with a bespoke written proposal that sets out the scope, deliverables, timeline, and cost. A formal contract is issued for larger engagements. Once both parties have signed or given written acceptance, those documents form the binding agreement and override any conflicting provisions here.
Payment
Our standard payment structure is 50% upfront to secure your place in our schedule and 50% upon project completion, prior to launch. Larger projects may be structured across multiple milestones as agreed in writing. Invoices are due within 7 days of issue. Invoices that remain unpaid after 14 days will accrue statutory interest in accordance with Cyprus law.
Client Responsibilities
You agree to provide any content, assets, and information we need in a timely manner. You confirm that you own or hold valid licences for all content you supply, and you accept full liability for any third-party intellectual property claims arising from content you provide.
Acceptable Use
We reserve the right to decline or terminate any project that involves illegal content, the promotion of violence, unlicensed gambling or adult material, or any deceptive or misleading practices under Cyprus or EU law.
Intellectual Property
Upon receipt of final payment, you receive full ownership of the design, custom code, and website we produced for you. Pre-existing frameworks, libraries, and tools developed independently remain the property of pix.cy. We retain the right to display completed work in our portfolio unless a non-disclosure agreement is in place.
Revisions & Scope Changes
Revisions within the agreed scope are included as specified in your proposal. Requests for features or work outside the original scope will receive a separate written quote at our standard rates. No out-of-scope work begins until you have confirmed the cost in writing.
Confidentiality
We treat all non-public client information as strictly confidential. We will not disclose your business details, strategies, or unreleased materials to any third party. This obligation continues indefinitely and applies solely to information shared for the purpose of delivering your project.
Data Protection
We comply with the General Data Protection Regulation (GDPR) and applicable Cyprus data protection law. Where a project involves processing personal data on your behalf, we are happy to enter into a Data Processing Agreement. Our Privacy Policy explains how we handle personal data in full.
Third-Party Services
Many projects rely on third-party platforms such as hosting providers, payment processors, or CMS tools. While we take care in selecting reliable providers, we are not responsible for their downtime, security incidents, pricing changes, or discontinuation of service.
Warranties
Our services are delivered with professional care and skill. However, we make no guarantees regarding specific search engine rankings, website traffic levels, sales figures, or other business outcomes. Results depend on many factors outside our control.
Limitation of Liability
Our total liability to you arising from or in connection with these Terms or any project is capped at the fees you have paid us in the twelve months preceding the claim. We are not liable for indirect, consequential, or incidental losses. Nothing in these Terms excludes liability for fraud or gross negligence as defined under Cyprus law.
Cancellation
Either party may terminate a project engagement with 14 days' written notice. Deposits paid before the project launches are non-refundable. For ongoing services such as hosting or maintenance, 30 days' notice is required to cancel.
Hosting & Maintenance
Hosting and maintenance plans are billed annually and renew automatically unless cancelled. We will give at least 60 days' written notice if we intend to discontinue a service.
Force Majeure
Neither party shall be liable for delays or failures caused by events beyond their reasonable control, including power outages, natural disasters, strikes, government actions, or pandemics.
Disputes & Governing Law
These Terms are governed by the laws of the Republic of Cyprus. Formal notices must be sent by email. In the event of a dispute, we ask that you contact us directly first so that we can try to resolve the matter promptly. If we cannot reach agreement, the dispute will proceed to mediation and, if necessary, to the courts of Cyprus as the final recourse.
General
These Terms, together with any signed proposals and contracts, form the entire agreement between us. We may engage subcontractors to assist with delivery. Neither party may assign their rights or obligations without the other's consent. Section headings are for convenience only. If these Terms are ever translated, the English version prevails.
